Netsave Terms & Conditions

Welcome to Netsave.
These Terms & Conditions ("Terms") govern your access to and use of the Netsave websites, mobile applications, marketplace, communications tools, delivery features, service-provider features, Connected Marketplaces, and other products and services made available by Netsave (collectively, the "Platform").
These Terms constitute a legally binding agreement between you ("you" or "User") and Netsave Inc. ("Netsave," "we," "us," or "our"). Netsave Inc, a Delaware corporation, with its principal place of business address at 218 NW 24th ST, Miami, FL 33127
By creating an Account, accessing the Platform, listing an item or service, purchasing an item, requesting a service or delivery, becoming a Seller, Service Provider or Driver, or otherwise using the Platform, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to create an Account or independently transact through Netsave.
If you use Netsave on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
You must provide accurate, current and complete information and update that information when necessary.
Netsave may impose additional eligibility requirements for Sellers, Service Providers, Drivers, business users, or particular Platform features.
2. Your Netsave Account
You are responsible for maintaining the confidentiality and security of your Account credentials and for activity occurring through your Account.
You may not:
- impersonate another person or organization;
- create an Account using false or misleading information;
- transfer or sell your Account without Netsave's authorization;
- use another person's Account without permission;
- circumvent Account restrictions or suspensions; or
- use Netsave for unlawful, fraudulent or abusive purposes.
Notify Netsave promptly if you believe your Account has been compromised.
A single Account may allow an eligible User to participate in multiple capacities, including as a buyer, Seller, Service Provider, or Driver, subject to any additional requirements applicable to those activities.
3. The Netsave Marketplace
Netsave provides a technology marketplace through which Users may discover, list, buy and sell new, used, refurbished and other permitted goods.
Unless expressly stated otherwise, Netsave does not own the goods listed by third-party Sellers and is not the Seller of those goods.
A transaction for a third-party Seller's item is generally between the buyer and Seller. Netsave may provide technology and related services facilitating discovery, communication, payment, transaction protection, pickup, delivery or other aspects of the transaction.
The availability of a feature does not mean that feature applies to every listing or transaction.
4. Sellers and Product Listings
Eligible Users may create listings for permitted goods.
By listing an item, the Seller represents and warrants that:
- the Seller owns the item or is legally authorized to sell it;
- the listing is accurate and not materially misleading;
- photographs accurately represent the item;
- the stated condition is accurate;
- the item is available for sale;
- the listing does not infringe third-party rights;
- the item may lawfully be sold; and
- the Seller will comply with applicable laws and Netsave policies.
Netsave may review, reject, modify the presentation of, restrict, suspend or remove listings that violate these Terms or other Platform policies.
Netsave does not guarantee that a listing will receive views, offers, inquiries or result in a sale.
5. Product Condition
Netsave may provide condition classifications including, as applicable, New, Like New, Excellent, Good, Fair, Refurbished, or other designations.
Sellers are responsible for selecting an accurate condition and disclosing material defects, damage, missing components or other information reasonably relevant to a buyer's decision.
A "Refurbished" designation does not constitute a certification by Netsave unless expressly stated otherwise.
6. Buying Products
Buyers are responsible for reviewing the listing, condition, price, fulfillment method, Seller information and other relevant information before completing a transaction.
Depending on the listing, transactions may support:
- electronic payment;
- local delivery;
- shipping;
- pickup;
- meetup;
- cash or other permitted in-person payment; or
- other fulfillment methods Netsave makes available.
Buyers and Sellers must comply with the terms applicable to the selected transaction method.
7. Offers and Negotiations
Netsave may allow Users to make, accept, decline or counter offers.
Submitting an offer does not necessarily complete a transaction. A binding purchase may arise only when the Platform identifies the transaction as completed or otherwise provides that an accepted offer creates a purchase obligation.
Users must not use offers, messaging or negotiations for fraud, harassment, manipulation or attempts to circumvent applicable Platform fees or protections.
8. Local Deals and In-Person Transactions
Certain Netsave listings may be offered through Local Deals, local pickup, meetup or other in-person transaction methods.
Users participating in an in-person transaction are responsible for exercising reasonable judgment and taking appropriate safety precautions.
Users should meet in appropriate public or otherwise safe locations when practical, inspect items before completing applicable in-person transactions, and avoid sharing unnecessary personal information.
Where payment occurs outside Netsave, Netsave's payment protection, refund or transaction-protection features may not apply.
Netsave does not guarantee the conduct of any User participating in an in-person transaction.
9. Vehicles - Cars & Trucks, and More
Netsave may provide a specialty marketplace category for Vehicles such as Cars & Trucks and other permitted vehicles.
Unless expressly stated otherwise, Netsave is a marketplace facilitating vehicle discovery and communication and is not the vehicle Seller, dealer, broker, title agency, financing provider, insurer, mechanic or vehicle inspector.
Vehicle Sellers are responsible for:
- having legal authority to sell the vehicle;
- accurately describing the vehicle;
- disclosing material information required by law;
- providing accurate mileage and vehicle information;
- satisfying title, registration and lien requirements;
- complying with dealer licensing requirements when applicable; and
- complying with all applicable federal, state and local laws.
Buyers are responsible for independently evaluating a vehicle before purchase, including its condition, history, title status and Seller information.
Netsave recommends that Users use appropriate inspection, title-verification and safe transaction practices.
Unless expressly offered by Netsave for a particular transaction, Netsave does not guarantee vehicle condition, ownership, title status, mileage, financing, inspection results or legal compliance.
10. Services Marketplace
Netsave may allow Users to discover and connect with individuals or businesses offering local professional or home services ("Service Providers").
Services may include furniture assembly, handyman and home repair, moving help, cleaning, appliance installation or repair, plumbing, lawn care and landscaping, electrical work, heating and cooling, junk removal, wall mounting and other permitted services.
Unless expressly stated otherwise, Service Providers are independent third parties and the services they advertise are not performed by Netsave.
Netsave provides technology that helps Users and Service Providers discover and communicate with each other.
11. Becoming a Service Provider
A User may be required to activate Service Provider status before advertising services.
Service Providers must provide accurate information and agree to applicable Service Provider requirements.
By offering services through Netsave, a Service Provider represents and warrants that:
- they are legally permitted and qualified to perform the services advertised;
- their service descriptions and pricing information are accurate;
- they will comply with applicable laws;
- they will perform services safely and professionally; and
- they will obtain and maintain any licenses, certifications, registrations, permits or insurance required for their services.
Netsave may request additional information or documentation and may restrict, suspend or remove Service Provider privileges or listings.
12. Licenses, Credentials and Service Provider Verification
Some services, including electrical, plumbing, HVAC, construction and certain repair or installation work, may require professional licenses or other credentials depending on jurisdiction.
Service Providers are responsible for determining and complying with requirements applicable to them.
The presence of a Service Provider on Netsave does not by itself mean Netsave has verified the provider's professional qualifications, background, licensing or insurance.
Netsave will use labels such as Identity Verified, License Verified, Insurance Verified, Background Checked, or similar designations only to identify the particular verification Netsave states it has performed.
No badge constitutes a guarantee of future conduct or quality of work.
13. Service Transactions
Unless Netsave expressly provides booking and payment functionality for a particular service, the agreement to perform a service is between the User requesting the service and the Service Provider.
The parties are responsible for agreeing on:
- scope of work;
- pricing;
- timing;
- materials;
- location;
- cancellation terms;
- warranties; and
- other applicable conditions.
Netsave does not guarantee the quality, safety, legality, suitability, pricing or outcome of services performed by independent Service Providers.
Users should evaluate providers and use reasonable judgment before allowing someone into their home, workplace or other property.
14. Local Delivery
Netsave may facilitate local delivery for eligible marketplace transactions.
Availability, pricing, delivery radius, timing, item eligibility and other conditions may vary by location, item, Seller, Driver or transaction.
Delivery estimates are estimates unless Netsave expressly guarantees otherwise.
Sellers must provide accurate information concerning an item's dimensions, weight, condition, pickup location and special handling requirements.
Users must not request transportation of illegal, hazardous, prohibited or inaccurately described goods.
15. Drivers and Delivery Providers
Netsave may allow eligible individuals or third-party delivery businesses ("Drivers") to perform deliveries associated with marketplace transactions.
Drivers may be required to satisfy eligibility requirements established by Netsave, which may include providing evidence of:
- identity;
- minimum age;
- valid driver's license;
- vehicle information and registration;
- legally required automobile or commercial insurance;
- authorization to work or provide delivery services; and
- other documentation Netsave reasonably requires.
Drivers must comply with applicable laws, operate safely, handle Users' property with reasonable care and promptly report accidents, damage, loss or safety incidents.
Driver relationship
The legal relationship between Netsave and Drivers depends on Netsave's actual operating model and applicable law.
Netsave will not characterize a Driver as an independent contractor merely by virtue of this Agreement where applicable law or the actual relationship provides otherwise.
16. Delivery Damage, Loss and Claims
Users should inspect items when appropriate and promptly report suspected loss or damage associated with delivery.
Any reimbursement, protection or claims program offered by Netsave will be governed by the rules applicable to that program at the time of the transaction.
Netsave may request photographs, transaction records, communications, proof of value or other information reasonably necessary to investigate a claim.
Submitting false claims may result in Account suspension or termination.
17. Connected Marketplaces and Cross-Listing
Netsave may allow Users to connect third-party marketplaces, commerce platforms or other accounts through features such as Connected Marketplaces.
These features may allow Users to import, synchronize, manage or distribute listing information.
By connecting a third-party account, you represent that:
- you own or are authorized to use that account;
- you authorize Netsave to access and process permitted account/listing information;
- your use complies with the third party's terms; and
- information imported or distributed through Netsave may lawfully be used for that purpose.
Third-party marketplaces remain independent from Netsave.
Netsave does not guarantee uninterrupted synchronization, listing acceptance, inventory accuracy or continued availability of third-party APIs or integrations.
Users remain responsible for avoiding duplicate sales and maintaining accurate inventory where synchronization is unavailable, delayed or unsuccessful.
Third-party services may modify, restrict or discontinue integrations at any time.
18. Payments
Netsave may facilitate electronic payments through third-party payment processors.
By using electronic payment features, you authorize Netsave and its payment providers to process transaction information as necessary to complete payments, refunds, payouts, fees, fraud prevention and related functions.
Payment methods and availability may vary.
Users must provide accurate payment information and have legal authority to use the selected payment method.
Netsave may delay, cancel or restrict transactions when reasonably necessary to prevent fraud, comply with law, address disputes or protect Platform Users.
19. Fees
Netsave may charge fees for certain transactions, delivery services, promoted listings, subscriptions, seller tools, vehicle listings, business features or other products.
Applicable fees will be disclosed before the User purchases or uses the relevant paid feature.
Netsave may change its fees prospectively.
Taxes may apply depending on the transaction and jurisdiction.
20. Transaction Protection, Refunds, Returns and Cancellations
Different Netsave transactions may have different fulfillment and protection rules.
Any return, refund, cancellation or buyer/seller protection rights are subject to the policy presented for the applicable transaction.
Local meetup, cash, vehicle and independent service transactions may not qualify for the same protections as eligible electronically processed marketplace purchases.
Nothing in these Terms limits non-waivable consumer rights provided by applicable law.
Returns Policy
The following Returns Policy applies to purchases delivered within the United States and forms part of these Terms and Conditions:
- Return window: You may request a return within 30 days of the delivery date.
- Return method: Eligible Goods are returned by mail.
- Return shipping costs: Buyers are generally responsible for the cost of return shipping.
- Refunds: Once We receive the returned Goods, We will process Your refund no later than 14 days, using the same means of payment You used for the Order.
Your right to cancel an Order only applies to Goods that are returned in the same condition as You received them. You should also include all of the products instructions, documents and wrappings. Goods that are damaged or not in the same condition as You received them or which are worn simply beyond opening the original packaging will not be refunded. You should therefore take reasonable care of the purchased Goods while they are in Your possession.
21. Prohibited Items, Services and Conduct
Users may not use Netsave to list, sell, purchase, request, transport or promote anything prohibited by law or Netsave policy.
Users may not:
- commit or facilitate fraud;
- misrepresent an item, service, identity or qualification;
- harass, threaten or discriminate against another User;
- impersonate another person;
- manipulate reviews, offers, transactions or Platform metrics;
- distribute malware;
- infringe intellectual-property rights;
- misuse another User's personal information;
- circumvent Netsave safety controls;
- use Netsave for unlawful activity; or
- attempt to evade fees applicable to a transaction through deceptive conduct.
Netsave may establish additional prohibited-items and prohibited-services policies.
22. Trust, Safety and Verification
Netsave may use identity, phone, email, account, behavioral, automated, artificial-intelligence-assisted or third-party tools to detect fraud, abuse and safety risks.
Verification reduces certain risks but does not guarantee a User's identity, trustworthiness, qualifications or future conduct.
Users remain responsible for exercising reasonable judgment when interacting or transacting with others.
Netsave may restrict, review or suspend activity where fraud, safety or policy concerns arise.
23. User Content
Users may submit photographs, videos, listing descriptions, reviews, messages, profile information and other content ("User Content").
You retain ownership of your User Content.
By submitting User Content, you grant Netsave a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, modify for formatting, display, distribute and otherwise use that content as reasonably necessary to operate, improve, market and promote the Platform and your listings.
You represent that you have the rights necessary to submit the content and grant this license.
24. Intellectual Property
The Platform, including Netsave's software, design, trademarks, logos, features and original content, is owned by Netsave or its licensors and protected by applicable intellectual-property laws.
Except as expressly permitted, Users may not copy, modify, reverse engineer, distribute or commercially exploit Netsave intellectual property.
25. Copyright and DMCA
Netsave respects intellectual-property rights.
A copyright owner or authorized representative who believes content on Netsave infringes a copyright may submit a notice satisfying the requirements of the Digital Millennium Copyright Act, including identification of the copyrighted work, identification and location of the allegedly infringing material, contact information, the required good-faith and accuracy statements, and a physical or electronic signature.

26. Communications
By using Netsave, you may receive transactional communications concerning your Account, listings, purchases, sales, offers, messages, deliveries, service requests, safety or Platform operations.
Marketing communications will be handled in accordance with applicable law and your available communication preferences.
27. Third-Party Services
Netsave may integrate or link to services operated by third parties, including payment processors, marketplaces, mapping providers, commerce platforms, identity-verification services and other technology providers.
Those services may be governed by separate terms and privacy policies.
Netsave does not control third-party services and is not responsible for their independent acts, omissions, availability or policies except as required by law.
28. Suspension and Termination
Netsave may restrict, suspend or terminate an Account or access to particular Platform features where reasonably necessary because of:
- violation of these Terms;
- fraud or suspected fraud;
- unlawful conduct;
- safety concerns;
- repeated transaction problems;
- misuse of the Platform;
- nonpayment of applicable fees; or
- legal or regulatory requirements.
Where appropriate, Netsave may remove listings or content without terminating the entire Account.
Users may discontinue using Netsave or request Account closure subject to outstanding transactions and applicable retention requirements.
29. Disputes Between Users
Netsave encourages Users to attempt to resolve transaction disputes in good faith.
Netsave may provide support, reporting, refund, transaction-protection or dispute-resolution tools, but Netsave is not required to resolve every dispute between independent Users unless required by applicable law or a specific Netsave protection program.
Netsave may investigate reports and take Platform-level actions regardless of whether Users resolve their underlying dispute.
30. Disclaimer of Warranties
To the maximum extent permitted by law, the Platform is provided "AS IS" and "AS AVAILABLE."
Netsave does not warrant that the Platform will always be available, uninterrupted, error-free or secure.
Except for representations expressly made by Netsave, Netsave does not warrant or guarantee third-party goods, Sellers, Service Providers, Drivers, vehicles, services, listings or User Content.
Some jurisdictions do not permit certain warranty exclusions, so these limitations apply only to the extent permitted by applicable law.
31. Limitation of Liability
To the maximum extent permitted by applicable law, Netsave and its affiliates, officers, directors, employees and agents will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising from use of the Platform.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
32. Indemnification
To the extent permitted by law, you agree to indemnify, defend and hold harmless Netsave and its affiliates, directors, officers, employees and agents from claims, liabilities, damages, losses and reasonable expenses arising from:
- your violation of these Terms;
- your unlawful use of the Platform;
- your listings or User Content;
- goods you sell;
- services you provide;
- deliveries you perform;
- your violation of another person's rights; or
- your violation of applicable law.
This obligation applies only to the extent enforceable under applicable law.
33. Privacy
Your use of Netsave is subject to the Netsave Privacy Policy.
The Privacy Policy describes how Netsave collects, uses, shares and protects personal information.
Service Providers, Sellers and Drivers who receive another User's personal information may use that information only for legitimate purposes associated with the relevant transaction or service and as permitted by applicable law.
34. Governing Law
These Terms will be governed by the laws of Delaware, without regard to conflict-of-law principles, except where applicable law requires otherwise.
35. Dispute Resolution
Before initiating formal proceedings concerning a dispute with Netsave, you agree to contact Netsave and make a good-faith attempt to resolve the dispute informally.
Nothing in this section limits rights that cannot lawfully be waived.
36. International Users
Netsave may make some Platform functionality available outside the United States.
Users are responsible for complying with laws applicable to them.
Where mandatory consumer-protection or privacy laws apply and cannot contractually be waived, those rights remain unaffected by these Terms.
37. Changes to the Platform
Netsave may add, modify, suspend or discontinue Platform features.
Features described in these Terms do not have to be available in every location or to every User.
Netsave may test features with limited groups of Users or geographic markets.
38. Changes to These Terms
Netsave may update these Terms periodically.
When changes are material, Netsave will provide notice as required by applicable law.
The updated Terms will identify their effective or last-updated date.
Continued use after updated Terms become effective constitutes acceptance where permitted by law.
Where affirmative consent is legally required, Netsave will request it.
39. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent legally permissible and the remaining provisions will remain in effect.
40. No Waiver
Failure by Netsave to enforce a provision of these Terms does not waive Netsave's right to enforce it later.
41. Assignment
You may not assign or transfer your rights or obligations under these Terms without Netsave's written consent.
Netsave may assign these Terms in connection with a merger, acquisition, corporate reorganization, financing, sale of assets or other lawful business transaction, subject to applicable law.
42. Entire Agreement
These Terms, together with policies and supplemental terms expressly incorporated by reference, constitute the agreement between you and Netsave concerning the Platform.
Additional terms may apply to particular features, including delivery, promotional programs, subscriptions, payment services or other products.
43. Definitions
For purposes of these Terms:
- Account means a registered Netsave user account.
- Buyer means a User seeking or purchasing Goods.
- Connected Marketplace means a third-party marketplace, store, commerce platform or account connected to Netsave.
- Content means text, photographs, video, audio, data or other materials displayed through the Platform.
- Driver means an eligible individual or business performing or facilitating delivery through Netsave, subject to the applicable legal and operational arrangement.
- Goods means products or items offered through the Marketplace.
- Local Deal means a listing or transaction designed primarily for local discovery, delivery, pickup or meetup.
- Platform means Netsave's websites, mobile applications, marketplace and related features and technology.
- Seller means a User who lists or sells Goods through Netsave.
- Service Provider means a User or business advertising or providing Professional Services through the Platform.
- Professional Services means services advertised or offered by Service Providers through Netsave.
- User means a person or entity accessing or using Netsave.
